China, America and melamine

China's food supply appears to be awash in the industrial chemical melamine. Dangerous levels have been detected not only in milk and eggs, but also in chicken feed and wheat gluten, meaning that melamine is almost impossible to avoid in processed foods. Melamine in baby formula has killed at least four infants in China and sickened tens of thousands more.
In response, the United States has blasted lax Chinese regulations, while the Food and Drug Administration, in a rare move, announced last week that Chinese food products containing milk would be detained at the border until they were proved safe.
For all the outrage about Chinese melamine, what American consumers and government agencies have studiously failed to scrutinize is the place of melamine in America's own food system. In casting stones, we've forgotten that our house has its own exposed glass.
To be sure, in China some food manufacturers deliberately added melamine to products to increase profits. Makers of baby formula, for example, watered down their product, lowering the amount of protein and nutrients, then added melamine, which is cheap and fools tests measuring protein levels.
But melamine is also integral to the material life of any industrialized society. It's a common ingredient in cleaning products, waterproof plywood, plastic compounds, cement, ink and fire-retardant paint. Chemical plants throughout the United States produce millions of pounds of melamine a year.
Given the pervasiveness of melamine, it's always possible that trace elements will end up in food. The FDA thus sets the legal limit for melamine in food at 2.5 parts per million. This amount is indeed minuscule, a couple of sand grains in an expanse of desert that pose no real threat to public health. Moreover, the 2.5 parts per million figure is calculated for a person weighing 132 pounds - a cautious benchmark given that the average adult weighs 150 to 180 pounds.
But these figures obscure more than they reveal. First, while adults eat about one-fortieth of their weight every day, toddlers consume closer to one-tenth. Although scientists haven't measured the differential impact of melamine on infants versus adults, it's likely that this intensified ratio would at least double (if not quadruple) the impact of legal levels of melamine on toddlers.
This doubled exposure might not land a child in the hospital, but it could certainly contribute to the long-term kidney and liver problems that we know are caused by chronic exposure to melamine.
On a more concrete note, melamine not only has widespread industrial applications, but is also used to buttress the foundation of American agriculture.
Fertilizer companies commonly add melamine to their products because it helps control the rate at which nitrogen seeps into soil, thereby allowing the farmer to get more nutrient bang for the fertilizer buck. But the government doesn't regulate how much melamine is applied to the soil. This melamine accumulates as salt crystals in the ground, tainting the soil.
A related area of agricultural concern is animal feed. Chinese eggs seized last month in Hong Kong, for instance, contained elevated levels of melamine because of the melamine-laden wheat gluten used in the feed for the chickens that produced the eggs.
To think American consumers are immune to this unscrupulous behavior is to ignore the Byzantine reality of the global gluten trade. Tracking the flow of wheat gluten around the world is like trying to contain a drop of dye in a churning whirlpool.
More ominous, the United States imports most of its wheat gluten. Last year, for instance, the FDA reported that millions of Americans had eaten chicken fattened on feed with melamine-tainted gluten imported from China. Around the same time, Tyson Foods slaughtered and processed hogs that had eaten melamine-contaminated feed. The government decided not to recall the meat.
Only a week earlier, however, the FDA had announced that thousands of cats and dogs had died from melamine-laden pet food. This high-profile pet scandal did not prove to be a spur to reform so much as a red herring. Our attention was diverted to Fido and away from the animals we happen to kill and eat rather than spoil.
Frightening as this all sounds, the concerned consumer is not completely helpless. We can seek out organic foods, which are grown with fertilizer without melamine - unless that fertilizer was composted with manure from animals fed melamine-laden feed (always possible, as the Tyson example suggests).
We could further protect ourselves by choosing meat from grass-fed or truly free-range animals, assuming the grass was not fertilized with a conventional product (something that's also very hard to know).
But as all the caveats above indicate, these precautions will only go so far. Melamine, after all, points to the much larger relationship between industrial waste and American food production. Regulations might be lax when it comes to animal feed and fertilizer in China, but take a closer look at similar regulations in the United States and it becomes clear that they're vague enough to allow industries to "recycle" much of their waste into fertilizer and other products that form the basis of our domestic food supply.
As a result, toxic chemicals routinely enter our agricultural system through the back channels of this under-explored but insidious relationship.
So, sure, let's keep the heat on China. And, yes, let's take with a big dose of skepticism the Chinese government's assurances that they're improving the food supply.
At the same time, though, instead of delivering righteous condemnation, the United States should seize upon the melamine scandal as an opportunity to pass federal fertilizer standards backed by consistent testing for this compound, which could very well be hidden in plain sight.

U.S. food agency detains Chinese imports for testing

Candy, snacks, cereal and any other products from China that contain milk will be detained at the border until tests prove that they are not contaminated, the U.S. government announced Thursday.
The Food and Drug Administration said that it had issued the alert because of concerns about Chinese products being contaminated with the toxic chemical melamine. Since September, more than 50,000 infants in China have become ill and at least four have died because they tainted infant formula.
Since then, melamine has been found in a range of products, including milk, eggs and fish feed. Companies in the United States have recalled several products, including non-dairy creamer and a type of candy, which are primarily sold in Asian markets, because of melamine concerns but to date the contamination here was not thought to be widespread.
"We're taking this action because it's the right thing to do for the public health," said Dr. Steven Solomon, an FDA deputy associate commissioner.
As a result, Chinese products that contain milk or milk powder will be detained until the manufacturer or its customer has the product tested and found to be free of contamination, or they show documentation indicating that the product does not contain milk or milk-derived ingredients.
"The burden shifts to the importer," Dr. Solomon said.
FDA analyses have detected melamine and cyanuric acid, another toxic chemical, in "a number of products that contain milk or milk-derived ingredients, including candy and beverages," according to an alert that the agency sent to field personnel. The alert also noted that inspectors in 13 other countries had discovered melamine in Chinese products including milk, yogurt, frozen desserts, biscuits, chocolates and cookies.
The FDA routinely blocks imports of individual food products, but it is rare for the agency to block an entire category of foods from a particular country. Last year, the FDA blocked five types of farm-raised seafood as well as vegetable protein from China because of repeated instances of contamination from unapproved animal drugs and food additives.
Unscrupulous food and feed dealers in China add melamine to their products because it fools tests that measure protein levels. Because it dissolves poorly, melamine can block the body's filtering system, potentially leading to kidney failure and death.
Dr. Solomon said that the alert would probably apply mostly to specialty products sold in Asian markets. But Benjamin England, a former lawyer at the FDA, described the latest alert as "massive" and said it could affect "a tremendous amount of goods."
"It's going to jam the ports up all the up the supply chain," said England, who represents food supply companies.
As a result of the earlier alerts on seafood and vegetable protein, most private laboratories that perform product tests for melamine already have long waiting lists, England said. And the FDA takes three to four weeks to review submitted tests, England said.
Chinese producers of shrimp, for instance, recently started breading their product to avoid a controversy over an anti-dumping lawsuit, England said. But breading often contains dairy, and that product could be detained at ports.
The effect of the alert will probably be long-lasting, England said, because importers must prove that each and every shipment is free of contamination.
"It's impossible to get off the alert list," England said.

More candy from China, tainted, is in U.S. (IHT)

SHANGHAI: More contaminated Chinese candy was discovered in the United States on Wednesday, this time in Connecticut, where consumer protection officials issued a public warning against eating the sticky sweet.
In China, meanwhile, a couple filed a lawsuit against the company at the center of the scandal despite efforts by the authorities to keep it out of the courts.
The discovery in Connecticut involved the White Rabbit Creamy Candy brand, which is made in Shanghai and has already been pulled from stores in Britain and many Asian countries. Jerry Farrell Jr., Connecticut's consumer protection commissioner, announced that contaminated candy was found at two stores in New Haven, a market in West Hartford and a store in East Haven. In each case, testing found traces of an industrial additive, melamine, in the candy.
"We're concerned, obviously, there may have been bags sold of these before we got to them," Farrell said Wednesday, according to The Associated Press.
Last month, the Food and Drug Administration warned consumers about White Rabbit candy, and in California, health officials have found traces of melamine after testing samples of White Rabbit. The American distributor of the candy has already ordered a recall, but some candy may still remain in stores.
Melamine is a chemical additive at the heart of China's contaminated dairy scare. It is used to make plastics and fertilizers, but it is sometimes illegally mixed into food products, including milk, because its high levels of nitrogen can help fool tests that measure protein levels.
In September, Chinese authorities acknowledged that more than 53,000 Chinese infants had been sickened after consuming powdered baby formula that had been contaminated with melamine. Of that total, 13,000 were hospitalized and four have died.
Initially, the contamination seemed isolated to powdered baby formula as the state media focused on one company, the Sanlu Group, as the worst offender. But officials then announced that tests had found traces of melamine in formula produced by 21 other Chinese dairy companies.
This week, the list of offenders grew longer as new government tests found traces of melamine in some batches of dairy products produced by 15 other companies, according to news agency reports. And traces of melamine have also been found in limited samples of yogurt and other products made with Chinese dairy ingredients.
The scandal has focused widespread public anger at the government. Beijing has sought to blame dairy companies and local officials, especially in Shijiazhuang, the provincial capital where the Sanlu Group has its headquarters. This week, People's Daily, the authoritative newspaper of the Communist Party, carried an unusual article in which a spokesman in Shijiazhuang apologized but also accused officials at Sanlu of asking for a cover-up of the problem in August, shortly before the beginning of the Olympics.
The People's Daily article never addressed whether city officials participated in a cover-up but stated that they did not inform higher officials in the province of the problem until a month later.
Meanwhile, Caijing, one of China's leading independent magazines, reported this week that the parents of a 1-year-old boy had sued the Sanlu Group because the infant developed kidney stones after drinking the company's powdered baby formula. The parents, who reside in Henan Province in central China, are asking for $22,000 in compensation. However, Caijing reported that the local court had yet to accept their lawsuit, a tactic often used in China's legal system to prevent politically delicate subjects from being litigated.
For weeks, several defense lawyers in Beijing have been besieged with requests from parents to file lawsuits related to the scandal. One lawyer, Li Fangping, said his office had received more than 1,200 inquiries from parents. But Li said that the city's legal association had advised lawyers not to file lawsuits in the matter.

U.S. food watchdog defends plastic linked to health risks (IHT)

WASHINGTON: With scientists at odds about the risks of a chemical found in plastic baby bottles, metal cans and other food packaging, the government on Tuesday gave consumers some tips on how to reduce their exposure to BPA even as it said the substance is safe.
A Food and Drug Administration advisory committee met as a major study linked bisphenol A to possible risks of heart disease and diabetes. The scientific debate could drag on for years.
"Right now, our tentative conclusion is that it's safe, so we're not recommending any change in habits," said Laura Tarantino, head of the FDA's office of food additive safety. But she acknowledged, "there are a number of things people can do to lower their exposure."
For example, consumers can avoid plastic containers imprinted with the recycling number '7,' as many of those contain BPA. Or, Tarantino said, they can avoid warming food in such containers, as heat helps to release the chemical.
More than 90 percent of Americans have traces of BPA in their bodies, but the FDA says the levels of exposure are too low to pose a health risk, even for infants and children. Other scientists, however, say BPA has been shown to affect the human body even at very low levels.
And Tuesday a study released by the Journal of the American Medical Association suggested a new concern about BPA. Using a health survey of nearly 1,500 adults, the study found that those exposed to higher amounts of BPA were more likely to report having heart disease and diabetes. Because of the possible public health implications, the results "deserve scientific follow-up," its authors said.
The study is preliminary, far from proof that the chemical caused the health problems. Two Dartmouth College analysts of medical research said it raises questions but provides no answers about whether the ubiquitous chemical is harmful.
FDA officials said they are not dismissing such findings. "We recognize the need to resolve the concerning questions that have been raised," said Tarantino, acknowledging that more research is needed. But the FDA is also arguing that the studies with rats and mice it relied on for its assessment are more thorough than some of the human research that has raised doubts.
The agency has asked an outside scientific panel for a second opinion on BPA's safety, and the medical journal article was released to coincide with the advisers' hearing. The FDA has the power to ban or limit use of BPA in food containers and medical devices.
Past animal studies have suggested reproductive and hormone-related problems from BPA. The JAMA study is the largest to examine possible BPA effects in people and the first suggesting a direct link to heart disease, said scientists Frederick vom Saal and John Peterson Myers, both longtime critics of the chemical.
Still, they said more rigorous studies are needed to confirm the results.
Vom Saal is a biological sciences professor at University of Missouri who has served as an expert witness and consultant on BPA litigation. Myers is chief scientist at Environmental Health Sciences, a Charlottesville, Va., nonprofit group. They wrote an editorial accompanying the JAMA study.
BPA is used in hardened plastics and in a wide range of consumer goods, including the lining of metal cans, eyeglass lenses and compact discs. Many scientists believe it can act like the hormone estrogen, and animal studies have linked it with breast, prostate and reproductive system problems and some cancers.
Researchers from Britain and the University of Iowa examined a U.S. government health survey of 1,455 American adults who gave urine samples in 2003-04 and reported whether they had any of several common diseases.
Participants were divided into four groups based on BPA urine amounts; more than 90 percent had detectable BPA in their urine.
A total of 79 had heart attacks, chest pain or other types of cardiovascular disease and 136 had diabetes. There were more than twice as many people with heart disease or diabetes in the highest BPA group than in the lowest BPA group. The study showed no connection between BPA and other ailments, including cancer.
No one in the study had BPA urine amounts showing higher than recommended exposure levels, said co-author Dr. David Melzer, a University of Exeter researcher.
Drs. Lisa Schwartz and Steven Woloshin of the Dartmouth Institute for Health Policy and Clinical Practice said the study presents no clear information about what might have caused participants' heart disease and diabetes.
"Measuring who has disease and high BPA levels at a single point in time cannot tell you which comes first," Schwartz said.
The study authors acknowledge that it's impossible to rule out that people who already have heart disease or diabetes are somehow more vulnerable to having BPA show up in their urine.
The American Chemistry Council, an industry trade group, said the study is flawed, has substantial limitations and proves nothing.
But Dr. Ana Soto of Tufts University said the study raises enough concerns to warrant government action to limit BPA exposure.
"We shouldn't wait until further studies are done in order to act in protecting humans," said Soto, who has called for more restrictions in the past.
An earlier lab experiment with human fat tissue found that BPA can interfere with a hormone involved in protecting against diabetes, heart disease and obesity. That study appeared online last month in Environmental Health Perspectives, a monthly journal published by the National Institutes of Health.
One of the FDA's outside advisers was skeptical of the JAMA study. "For diabetes, I really don't see it," said Dr. Garret FitzGerald of the University of Pennsylvania. As for a link to heart disease, FitzGerald questioned why the JAMA study did not also find high blood pressure problems in the people exposed to higher amounts of BPA.
Toxicology experts from another government agency have studied BPA and recently completed their own report. They found no strong evidence of health hazards from BPA, but unlike the FDA, said there was "some concern" about possible effects on the brain in fetuses, infants and children.
Several states are considering restricting BPA use, some manufacturers have begun promoting BPA-free baby bottles, and some stores are phasing out baby products containing the chemical. The European Union has said BPA-containing products are safe, but Canada's government has proposed banning the sale of baby bottles with BPA as a precaution.
The FDA advisory panel is expected to make its recommendations to the FDA late next month.
